Morgan Stanley Smith Barney LLC ("Morgan Stanley") distributes to E*TRADE from Morgan Stanley customers quotes, last sale prices, volume, depth-of-book, other current and historical pricing information, and other data (collectively, "Market Data") that it receives from so-called Securities Information Processors ("SIPs") (e.g., the Unlisted Trading Privileges Operating Committee, the Consolidated Tape Association, and the Options Price Reporting Authority), other U.S. securities and commodities futures exchanges (including the New York Stock Exchange, The Nasdaq Stock Market, CME Group, Inc., ICE Futures U.S., Inc., Cboe Futures Exchange, LLC, and LMX Labs, LLC), certain market data consolidators (including, but not limited to, S&P Dow Jones Indices LLC, S&P Global Market Intelligence LLC, and Moody’s Research (and any successors or assigns)), and CUSIP Global Services (collectively, "Market Data Providers"), in accordance with the terms set forth in E*TRADE from Morgan Stanley’s various subscription agreements with the Market Data Providers. Subject to certain eligibility requirements and fees, E*TRADE from Morgan Stanley customers may receive Market Data on either a real-time or delayed (by at least 15 minutes) basis. Equities data is either real-time Nasdaq Basic or Consolidated Tape Association and Unlisted Trading Privileges data from the SIPs depending on your market data subscriptions and preferences. Options data is consolidated Options Price Reporting Authority data. OTCQX, OTCQB and OTC Pink data is provided by OTC Markets Group. The Market Data that E*TRADE displays is the exclusive property of the respective Market Data Providers. Market Data may not be copied or otherwise reproduced, repackaged, further transmitted, transferred, disseminated, redistributed or resold, or stored for subsequent use for any such purpose, in whole or in part, in any form or manner or by any means whatsoever, without prior written consent by the appropriate Market Data Providers.

The Market Data Providers reserve all rights to the Market Data they distribute to Morgan Stanley and which we make available to you. You understand and acknowledge that such Market Data does not constitute investment advice and that any reference to a particular investment, security, futures contracts, or futures option is not a recommendation to buy, sell, or hold any investment or security or to make any other investment decision.
